1. General Provisions
These rules of purchase and sale (hereinafter referred to as the Rules) establish the mutual rights, obligations and responsibilities of the Buyer and Margarita Glumbakė, whose individual activity code is 1467815, registered office address Beržės g.46, Rimučiai village, Širvintų district, Lithuania, tel. no. +370 63006351 (hereinafter referred to as the Seller) when the Buyer purchases goods in the e-shop.
2. Conclusion of the purchase and sale agreement
The purchase and sale agreement between the Buyer and the Seller is considered concluded from the moment when the Buyer, having created a basket of goods in the e-shop, specified the delivery address, selected the payment method, the bank from which the payment will be made and having familiarized himself with these rules, clicks the button "Confirm order and proceed to payment". The agreement is valid until the obligations under the rules of this agreement are fully fulfilled.
3. Buyer's rights and obligations
3.1. In accordance with these Rules and the legal acts of the Republic of Lithuania, the Buyers of the e-store are:
3.1.1. capable natural persons, i.e. persons who have reached the age of majority, whose legal capacity is not restricted by court order;
3.1.2. minors from fourteen to eighteen years of age, only with the consent of their parents or guardians, except in cases where they independently dispose of their income;
3.1.3. legal entities;
3.1.4. authorized representatives of all the above-mentioned persons.
3.2. The Buyer (consumer) has the right to withdraw from the contract of sale of goods with the Seller by notifying the Seller in writing within 14 business days from the date of delivery of the goods, in accordance with the Order of the Minister of Economy of the Republic of Lithuania No. 17 of August 2001. 258 “On approval of the rules for the sale of goods and the provision of services when contracts are concluded using communication means”.
3.3. The Buyer must accept the ordered goods and pay the price of the goods and their delivery.
3.4. If the data provided in the Buyer’s registration form changes, the Buyer must immediately update them.
3.5. The goods selected by the Buyer are reserved and the Seller begins to execute the purchase and sale agreement only when the Seller receives a notification from the Buyer’s bank about payment for the selected goods. The Buyer must confirm the payment order no later than 24 hours after clicking the “Confirm order and proceed to payment” button. If the payment order is not confirmed within this period, the Seller has the right to consider that the Buyer has refused the purchase and sale agreement.
3.6. In order to return a quality product, the Buyer must contact the Seller by e-mail: info@smolis.lt. The returned goods must be in the original manufacturer's packaging, undamaged. When returning the goods, a document confirming payment for the goods must be attached. The Buyer shall pay the costs of returning the goods.
3.7. The Buyer must comply with other requirements established in the Rules and the legal acts of the Republic of Lithuania.
4. Seller's rights and obligations
4.1. If the Buyer tries to harm the work or stable operation of the e-store, the Seller may, without prior notice, limit, suspend (terminate) his ability to use the e-store.
4.2. The Seller has the right to temporarily or indefinitely terminate the e-store's activities without separate notice.
4.3. The Seller has other rights provided for in the Rules and the legal acts of the Republic of Lithuania.
4.4. The Seller must enable the Buyer to properly use the services provided by the e-store.
4.5. The Seller must organize the delivery of the goods ordered by the Buyer to the address specified by the Buyer.
4.6. The Seller, in the event of important circumstances, being unable to deliver the ordered goods to the Buyer, undertakes to offer the Buyer an analogous goods, and if the Buyer refuses to accept the analogous goods, to return the money paid by the Buyer within 7 working days, if the Buyer has made an advance payment.
4.7. If the purchased goods did not meet the quality requirements, the Seller undertakes to replace the goods of inadequate quality with goods of adequate quality, reduce the price of the goods accordingly or refund the money paid for the goods and their delivery within 7 days from the submission of the request.
4.8. Upon termination of the contract, the Seller undertakes to refund the money for the returned goods in good condition within 7 days.
5. Delivery of goods
5.1. The Seller delivers the ordered goods within 2-3 business days, during holidays or emergencies within 5 business days from the receipt of payment for the goods.
5.2. Upon receipt of the goods, the Buyer, together with the carrier, must check whether the condition of the goods is not damaged. If the goods were damaged, the Buyer must note this in the goods transfer-acceptance document (waybill). Upon receipt of the goods and signing the goods transfer-acceptance document (waybill) without comments, it is confirmed that the goods were not damaged and were properly delivered.
6. Return of goods
6.1. The return of goods purchased in the e-store is carried out in accordance with the Civil Code of the Republic of Lithuania, Order No. 258 of the Minister of Economy of the Republic of Lithuania of 17 August 2001 “On the approval of the rules for the sale of goods and the provision of services when contracts are concluded using means of communication” and Order No. 217 of the Minister of Economy of the Republic of Lithuania of 29 June 2001 “On the approval of the rules for the return and exchange of goods”.
6.2. The Seller shall exchange or accept back the goods that the Buyer wishes to return with intact packaging and a proof of purchase document within 14 calendar days from the date of delivery of the goods:
6.2.1. SMolis studio at the address: Beržės g.46, Rimučių village, Širvintos district.
6.2.2. Via DPD or Omniva parcel machine at the address I. Šeinius g. 19, Širvintos (recipient - Margarita Glumbakė). The delivery costs of the goods are not refundable. The Buyer shall return the unsuitable goods by his own transport or pay the return costs.
6.3. If the Buyer decides to terminate the contract and informs the Seller about this, the Buyer loses the right to use the goods from the date of sending the notification. The date and time of sending the notification are determined according to the time of sending the Buyer's notification. If it is determined that the goods have been consumed (used) after the notification was sent, the Seller has the right to refuse to terminate the contract.
6.4. The Buyer may exercise the right to return the goods if the goods have not been used, the original packaging of the goods is not damaged and has not lost its commercial appearance. The returned goods must be fully completed. The Buyer is responsible for the complete completion and packaging of the item. If the goods are not fully completed and properly packaged, the Seller or its representative may refuse to accept the returned goods. Changes in the appearance of the goods or their packaging, which were necessary to inspect the goods, cannot be considered as significant changes in the appearance of the goods.
6.5. If the purchased goods did not meet the quality requirements, the Seller undertakes to replace the goods of inadequate quality with goods of adequate quality, reduce the price of the goods accordingly or refund the money paid for the goods and their delivery within 7 working days from the date of submission of the request. The goods must be returned in the original packaging of the goods and the shipment.
7. Liability
7.1. The Buyer is responsible for the correctness of the data provided in the registration form. The Buyer assumes responsibility for the consequences arising from the incorrectness or inaccuracy of the data provided in the registration form.
7.2. For the violation of the purchase and sale agreement concluded using the e-shop, the parties are liable in accordance with the procedure established by the legal acts of the Republic of Lithuania.
7.3. The Seller is not responsible for the information provided on the websites of other companies, even if the Buyer accesses these websites through the links in the Seller's e-shop.
7.4. In the event of damage, the guilty party shall compensate the other party for the losses incurred.
8. Sending information
8.1. The Seller shall send all notifications to the e-mail address provided in the Buyer's registration form.
8.2. The Buyer shall send all notifications and questions to the addresses specified in the "Contacts" section of the Seller's e-shop.
9. Gift vouchers
9.1. Gift vouchers are valid for 6 months from the date of purchase. After the expiration date of the gift voucher, the voucher ceases to be valid and the amount indicated in the voucher is non-refundable.
9.2. A gift voucher can be used to pay once.
9.3. When purchasing services or goods exceeding the amount indicated in the gift voucher, the remaining amount can be paid in cash or by bank transfer. If services for a lower amount are selected, the remaining amount indicated in the gift voucher is non-refundable.
9.4. In order to sign up for classes, it is necessary to do so 3 weeks before the expiration date of the voucher.
9.5. The voucher can be exchanged for classes or for ceramic products available in the studio.
10. Final provisions
All disagreements arising from the implementation of these rules are resolved through negotiations. If an agreement cannot be reached, disagreements are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
